ADDENDUM TO STANDARD CONDITIONS OF SALE

 RELATING TO THE SALE OF LIVE GAME:

 TERMS AND CONDITIONS

1. It is the responsibility of the PURCHASER to acquire permits required for the removal of game from source to final destination.The cost attached to acquisition of such permits shall be borne by the PURCHASER;

2. The SELLER of game is responsible for clearing the capture and removal thereof with the Conservation Department having jurisdiction thereover – the cost thereof to be for the account of the SELLER;

3. All game sold is to be captured and loaded by the SELLER within a period of two (2) months from date of the sale thereof – the SELLER to so act at his own cost and at the risk thereof. Such game is to be loaded with no injuries and with no obvious sickness. No guarantee concerning the state of health of the game is given by Elliott Brothers Auctioneers who will, however, insofar as is possible, assist in identifying any obvious illnesses as may be apparent therefrom.Elliott Brothers Auctioneers will not bear any responsibility for ensuring the capture and delivery to the PURCHASER of game sold and purchased, and although Elliott Brothers Auctioneers will assist towards canvassing suitable transport for the delivery of such game, it cannot guarantee the provision of suitable transport;.

4. Elliott Brothers Auctioneers will not accept any responsibility for any injuries as may befall the game or for any mortality which may occur in transit or boma.Game which may die in transit or subsequent to offloading from the vehicle of either the SELLER or the PURCHASER will not be replaced, nor will the purchase price thereof be refunded, by Elliott Brothers Auctioneers.The PURCHASER is advised to undertake insurance on game purchased;

5. Elliott Brothers Auctioneers does not accept any responsibility in the event of there being any misrepresentation on game for sale.No guarantee concerning the state of health of the game is given by Elliott Brothers Auctioneers who will, however, insofar as is possible, assist in identifying any obvious illnesses as may be apparent therefrom;

6. The PURCHASER is to pay to Elliott Brothers Auctioneers, immediately subsequent to the purchase of game, the full purchase price thereof.In the event of there being any amounts which become refundable to the PURCHASER, payment will be made within a period of sixty (60) days following upon the date of the sale and Elliott Brothers Auctioneers do not accept any responsibility for game purchased and not delivered within such time;

7. Should there exist reserve prices on any game, Elliott Brothers Auctioneers reserves the right to open bidding of such game at a level within it’s discretion;

8. Brothers Auctioneers do not give any guarantee that the exact  sexes  and  numbers  of game, as offered in the various  lots, will be delivered to the PURCHASER;

9. The role of Elliott Brothers Auctioneers is limited to provision of auction services relating to the game for sale;

10. The SELLER  undertakes  to make payment of the commission of Elliott Brothers Auctioneers, which commission is in an amount equivalent to 7,50% plus V.A.T @ 14 % of the price realized for the game sold – Elliott Brothers Auctioneers being authorized to offset such commission against proceeds of the game sold.Should there occur any differences in the numbers of game purchased and delivered, alteration to the commission of Elliott Brothers Auctioneers will be effected subsequent to the delivery of such game.
